These Terms of Service (“Terms”) govern your access to and use of CollectWisely (the “Service”). By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) About the Service
CollectWisely provides research and reference features related to artworks, artists, auctions, and market data. The Service is for informational purposes only
and does not constitute legal, tax, or investment advice.
2) Eligibility & Accounts
- You must be able to form a binding contract to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.
- You agree to provide accurate information and keep it up to date.
3) Subscriptions, Billing, and Refunds
- Some features require a paid subscription or pass.
- Prices, taxes, and plan details may change; changes apply prospectively unless required otherwise by law.
- Payments may be processed by third-party processors (e.g., Stripe). We do not store full payment card details.
- Refunds, if any, are handled according to the plan terms shown at purchase and applicable law.

Where a plan is advertised as offering unlimited artist searches or lot results, that is subject to our fair usage policy: each plan starts
with a published usage allowance, shown in your account under Profile, intended to comfortably cover individual research and collecting use.
Usage beyond that allowance is not automatically cut off — if your activity is consistent with normal individual use, we will generally extend
it on request. We may decline to extend, or may throttle or suspend access, where usage is inconsistent with individual research and collecting
use (for example, sustained bulk querying, automation, or use on behalf of multiple people or organizations) — see Section 4 (Acceptable Use).
4) Acceptable Use
You agree not to:
- Attempt to gain unauthorized access to the Service, user accounts, or systems.
- Scrape, harvest, or download data at scale, or use bots/automation in a way that harms the Service.
- Reverse engineer, decompile, or attempt to extract source code or non-public data.
- Use the Service for unlawful, infringing, or abusive purposes.
- Interfere with rate limits, security features, or access controls.
- Use a plan's search or lot-view allowance in a way inconsistent with individual research and collecting use, including sustained bulk querying, automated use, or sharing access across multiple people or organizations.
5) Intellectual Property
The Service and its content (excluding third-party content) are owned by CollectWisely and/or its licensors and are protected by intellectual property laws.
Third-party names, logos, images, and data remain the property of their respective owners.
6) Third-Party Links & Content
The Service may link to third-party websites (including auction house pages). We do not control, endorse, or assume responsibility for third-party content,
products, or services.
7) Data Accuracy & No Warranties
Market data may be incomplete, delayed, or contain errors. The Service is provided “as is” and “as available” without warranties of any kind, whether express
or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8) Limitation of Liability
To the maximum extent permitted by law, CollectWisely will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss
of profits, revenue, data, or goodwill arising from or related to your use of the Service.
9) Termination
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms or if necessary to protect the Service and users.
You may stop using the Service at any time.
10) Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
